5 Reasons to Use an Attorney for Child Custody Issues

Posted on July 7, 2021July 7, 2021 by Bill

When facing a child custody issue, you may find yourself wondering whether you really need to hire a child custody attorney. The need to hire an attorney can depend on a variety of issues. Among the most important of those issues is usually whether both parents can work out an agreement without the need for the court to get involved. While some parents may be able to do so, that is not always the case. Ultimately, you need to be prepared to fight for the best interest of your child. You may find that consulting with an attorney experienced in handling child custody cases is a good idea in the following situations.

1. The Other Parent Has Retained an Attorney

In situations in which the other parent has hired an attorney, you may find it beneficial to hire your own child custody attorney. Simply involving attorneys does not necessarily mean that the child custody arrangements will come down to a battle, it is always better to be prepared and ensured you are in the best situations to protect your parenting rights.

2. Circumstances Have Changed

It is not uncommon for child custody cases to begin simply enough but become more complicated when circumstances change. When this occurs, it is time to consult an experienced attorney. Situations that could complicate a child custody case include when one parent remarries or begins living with someone, when one parent is no longer abiding by the existing custody agreement when there is evidence of child abuse, child neglect, or domestic violence. You may also find it beneficial to hire a child custody attorney if either you or the other parent is considering relocation.

3. When the Other Parent Becomes Combative

It may be time to consult an attorney if the other parent has suddenly become combative, has indicated that he or she may try to convince the court that you are not fit to take care of your child, or has reversed their decision regarding shared custody. In most cases, the other parent will need to provide a substantial amount of evidence that any type of change in the custody agreement would be in your child’s best interest. Working with an experienced attorney can ensure that your rights are protected.

4. The Other Parent Is No Longer Allowing you to See your Child

Anytime the other parent interferes and prevents you from seeing your child, you should not hesitate in consulting with an attorney. Obstruction in your relationship with your child could include denying you time with the child, canceling visitation at the last minute, or obstructing any type of contact with your child, including phone calls, emails, and text messages.

5. You are Have a History of Substance Abuse

In the event you have a history of substance abuse, you should not hesitate in hiring an attorney to help with your child custody case. Your struggles with substance abuse, even if they are in the past, could be used against you in a child custody case. An attorney can help you to develop the best strategy to ensure you are able to win the best possible custody outcome.

If you find yourself in any of the above situations, it’s important that you do not delay in finding an experienced child custody attorney.
